Sparkletown Operations Pty Ltd ACN 640 766 552 and its subsidiaries (Sparkletown, we, our or us) is committed to complying with the Australian Privacy Principles as contained in the Privacy Act 1988 (Cth) (Privacy Act).
The purpose of this policy is to inform individuals about the manner in which Sparkletown collects, discloses and manages personal information. This policy appears on our website, and we will also provide a copy of this policy to anyone who makes a request, free of charge.
WHAT IS PERSONAL INFORMATION?
Personal information is defined in the Privacy Act to mean information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether the information or opinion is true or not, and whether the information or opinion is recorded in a material form or not.
Personal information can include sensitive information. Sensitive information is defined in the Privacy Act as information or an opinion about a person's race, ethnic origin, political opinions, membership of political associations and trade associations, religious or philosophical beliefs, sexual orientation or practices, criminal record, health information, genetic information about an individual that is not otherwise health information, biometric information that is used for the purpose of automated biometric verification or biometric identification and biometric templates.
Personal information can also include credit information, including:
identification information – name, date of birth, current or previous address, driver's licence number;
type and amount of credit sought;
trade references – name of entity, ABN, contact name, telephone number, fax number, email address, years trading with you;
publicly available information about an individual's creditworthiness;
default information;
new arrangement information;
court proceedings information;
personal insolvency information;
repayment history information;
payment information in relation to an overdue payment.
Not all information that we collect from you is personal information. Information that we collect from you that is de-identified or aggregated is not regulated by the Australian Privacy Principles.
WHOSE PERSONAL INFORMATION WE COLLECT
We generally collect personal information from the following individuals:
customers and landlords, including potential customers and landlords;
business associates and their employees;
visitors to our website;
contractors;
job applicants;
suppliers and their employees;
individuals who subscribe to our mailing lists; and
other individuals we interact with during the course of our business.
WHAT PERSONAL INFORMATION WE COLLECT
The types of personal information that we collect and hold may include:

contact details including address, email address and telephone number (including home, facsimile, work and mobile numbers); and
individual's occupation and details of the industry they work in; and
in the case of job applicant's qualifications, education, training, work experience and skills.
If we offer you credit, we may also collect credit information from you (as described above). If credit is offered, we may collect credit information through our staff, for example when you enquire about our services, or if you complete a credit application form. We may also collect credit information about you from third party sources, for example credit reporting agencies, publicly maintained records or trade referees.
We generally do not collect sensitive information, and would not do so without your consent.

HOW WE COLLECT PERSONAL INFORMATION
While we will usually collect information directly from you, personal information may be collected in a number of different ways including:

USE OF YOUR PERSONAL INFORMATION
We only collect personal information that is necessary for us to deal with your requests, to provide our products and services to you, to develop and promote our products and services, to manage our business and to assist us with complying with our legal and regulatory obligations. This includes:

We may use and disclose your personal information (other than sensitive information) to provide you with information about products or services offered by us or other parties.

Please note, we will not sell personal information, except as a part of the sale of our business.
DISCLOSURE OVERSEAS
We may disclose your personal information overseas.
You consent to any disclosure of your personal information by us overseas on the understanding that if the overseas recipient handles the personal information in breach of the Australian Privacy Principles, the recipient will not be accountable under the Act, and you will not be able to seek redress under the Act. The overseas recipient may not be subject to privacy obligations or any principles similar to the Australian Privacy Principles. Individuals may not be able to seek redress in some overseas jurisdictions, and overseas recipients may be subject to a foreign law that could compel the disclosure of personal information to a third party such as an overseas authority.
We do not disclose any credit information to entities that do not have an Australian link.
GOVERNMENT RELATED IDENTIFIERS
We do not use any government related identifiers, such as Medicare, driver's licence or passport numbers, as its own identifier of any individual. We will not use or disclose any government related identifiers other than in accordance with the Privacy Act.
DATA INTEGRITY
We endeavour to ensure that all personal information that we hold is accurate, complete and up-to-date. To assist us with this, individuals should contact us if any of their contact details or other personal information changes, or if they believe that the personal information that we have is not accurate or complete.
When personal information that we collect is no longer required by us, we will destroy or de-identify that personal information unless we are required by a law or a court/tribunal to retain the personal information.
We may retain personal information for so long as it is required for any of our business purposes, for the prevention of fraud, for insurance, legal and governance purposes and in our IT back up.
SECURITY OF YOUR PERSONAL INFORMATION
While we take reasonable steps to protect the personal information that we hold from misuse, loss, unauthorised access, modification or disclosure, you should be aware that no system is completely secure against cyber attack.
In addition, the open nature of the internet is such that information exchanged via the internet may be accessed and used by people other than those for whom the data is intended. Any information sent via the internet is sent at the sender's risk.
You should contact us immediately if you believe that there has been unauthorised access or disclosure with respect to any personal information that we hold about you.
ACCESS AND CORRECTION

We do not impose a charge for making a request for access, however we may charge for reasonable administrative costs incurred in providing access.
We encourage individuals to advise us if your personal information requires correction or updating. Sparkletown does not impose any charge with respect to requests for correction or updates.
Before correcting or providing access to personal information in response to a request, Sparkletown will require your identity to be confirmed.
We will respond to your request for access to your personal information within a reasonable time after you make the request and if access is granted, access will be provided within 30 days from your request. If we deny your request, we will provide you with a written notice detailing the reasons for the refusal and the process for making a complaint about the refusal to grant your request.
Where your request for access is accepted, we will provide you with access to your personal information in the manner requested by you, providing it is reasonable to do so.
We will accept your request for correction of your personal information where we are satisfied that it is inaccurate, out-of-date, incomplete, irrelevant or misleading.
Upon accepting a request for correction of your personal information, we will take all steps that are reasonable in the circumstances, having regard to the purpose for which your information is held, to correct your personal information.
AUTOMATED DECISION MAKING SYSTEMS
No personal information collected by us will be used by us in conjunction with the operation of a computer program or artificial intelligence to make, or do a thing that is substantially and directly related to making, a decision that could reasonably be expected to significantly affect the rights or interests of an individual.
COMPLAINTS
If you believe that we have breached this policy or the Privacy Act you may make a complaint. A written complaint can be emailed or posted to our us using the contact details set out below. Please include contact details for us to contact you regarding your complaint.
Our office will consider your complaint and respond as soon as reasonably possible, but not more than 30 days from receiving the complaint.
